Common issues reported by buyers

These are concerns to check, not a finding that every purchaser experienced them or that any company violated the law.

01

Five-year balloon payments

A loan may mature after five years even when its monthly payment follows a much longer repayment schedule. Making every installment can still leave a large balance due.

What to check

Check the note’s maturity date, interest rate, original principal, monthly payment and amortization term.

02

Minimal principal reduction

Early payments on an interest-bearing loan may go mainly toward interest. A slowly declining balance alone does not establish misconduct.

What to check

Compare payment history with an amortization schedule and separate principal and interest from fees or escrow.

03

Residential-use declarations

Some buyers report documents describing a nonresidential or investment purpose despite plans to live on the land. The wording and circumstances need individual review.

What to check

Look for primary-residence, occupancy, business-purpose and investment-purpose language. Preserve messages about intended use.

04

Property taxes

Buyer accounts describe disputed taxes, prior delinquency and promises to resolve balances. Obligations depend on the documents and transaction.

What to check

Confirm account balances directly with the county tax assessor-collector. The appraisal district determines appraised values; it may not collect your taxes.

05

Electricity availability

A nearby line does not necessarily establish the cost or timing of a new service connection. Some buyers report unexpected costs or delays.

What to check

Ask the utility provider for written service availability, an installation estimate and a timeline.

06

Wells and septic systems

Permits, installation and site conditions can affect costs and timing. The research report identifies historical well-permitting records; later outcomes need verification.

What to check

Confirm well requirements with the local groundwater district and septic requirements with the local permitting authority.

07

Late payments and default

A contract may include late fees, cure requirements, acceleration or foreclosure provisions. Applicable protections depend on the agreement and law.

What to check

Read the payment deadline, notice provisions and default clauses. Seek qualified advice promptly after a notice.

08

Unfulfilled sales promises

Buyers have reported disagreements over utilities, roads, driveways, wells, septic work and other improvements. These accounts are allegations, not findings.

What to check

Preserve advertisements, dated photos, messages, written estimates, receipts and the signed agreement.

09

Purchasing additional acreage

One reported concern involves encouragement to buy extra acreage based on competing interest or a package-sale condition. Its frequency has not been established.

What to check

Preserve the sales messages and compare the property originally requested with what was purchased.

10

Foreclosure and property loss

Historical notices name Viva Farms LLC in financing-related proceedings. A notice does not establish a completed foreclosure or wrongdoing.

What to check

Keep all notices and payment records. Obtain independent legal advice promptly; do not wait for a possible group action.
